These Terms and Conditions ("Terms") govern the websites, forms, applications and borrower and provider portals operated by Beautifi Solutions Inc. ("Beautifi," "we," "us" or "our") that link to them, together with our related patient-financing services (the "Services"). They also apply when you access our Services through a clinic or partner platform. Equipment financing and related services have separate agreements and policies and are outside these Terms.
When you select a box, click a button or take another action expressly identified as accepting these Terms, you agree to them. Read these Terms before accepting. The credit authorizations below apply at the specified application and loan stages. Simply browsing a website, creating an account without submitting an application, or requesting information does not authorize a credit inquiry.
Your loan agreement, payment authorization, clinic agreement or signed pricing schedule governs its particular subject and prevails over these Terms if there is a conflict. These Terms supplement those documents; they do not replace required disclosures or consents, or override rights that cannot lawfully be waived. Our Privacy Policy explains how we handle personal information.
The Services are intended for use in Canada by people aged 18 or older. To borrow, you must also have reached the age of majority in your province or territory, have legal capacity and meet the applicable eligibility requirements. If you access the Services from outside Canada, you are responsible for complying with applicable local laws. Availability varies by province, clinic and program.
Beautifi provides unsecured consumer financing directly as lender of record and helps people connect with healthcare providers. Your loan agreement identifies the lender and sets out your specific loan amount, interest, fees and payment obligations. A subsequent permitted assignment does not change the identity of the originating lender.
Calculators, examples and website descriptions are illustrative and are not a financing offer. Creating an account, applying or receiving a qualification result does not commit you to a loan or guarantee funding. Approval is at Beautifi's discretion, subject to applicable law, verification and the conditions of your offer and agreement. We may decline an application or withdraw an unaccepted offer where permitted. Any action affecting an accepted agreement or committed advance is subject to that agreement and applicable law.
Qualification. When you submit a qualification application and accept these Terms, you authorize Beautifi to obtain a soft credit inquiry from credit reporting agencies to assess your eligibility and creditworthiness. A soft inquiry does not affect your credit score.
Proceeding with a loan. When you agree to sign a Beautifi loan agreement, you authorize Beautifi to obtain a hard credit inquiry to complete the credit assessment for that loan. For ecommerce financing, this authorization applies when you sign the loan agreement. Beautifi may perform the hard inquiry at its discretion and may decide not to do so in some circumstances. A hard inquiry may affect your credit score. Submitting a qualification application alone does not authorize a hard inquiry under this paragraph.
While you are an active borrower. You authorize Beautifi to obtain further soft or hard credit inquiries where reasonably necessary to monitor and administer your existing account, assess additional credit you request, or collect amounts owing. We limit inquiries to these purposes and comply with applicable law, including any requirement for further notice or consent. A further hard inquiry may affect your credit score. This authorization does not permit inquiries for unrelated marketing.
Reporting. You authorize Beautifi to disclose information about your loan and account performance to credit reporting agencies, including identifying information, the loan amount, outstanding balance, payment history, late or missed payments, default and account closure or satisfaction. We may report this information as permitted by law, including corrections and final account updates. Reporting may affect your credit history and score.
These authorizations apply to each applicant, co-applicant or co-signer who personally accepts them. One person's acceptance does not authorize a credit inquiry on another person. We use credit information only for the identified purposes and handle it as described in our Privacy Policy.
You may ask about or withdraw consent by contacting privacy@beautifi.com or 1-800-969-7034, subject to legal or contractual restrictions and reasonable notice. We will explain the consequences. Withdrawal may prevent us from processing an application or providing further credit. It does not cancel an existing debt, reverse a lawful inquiry or reporting already completed, or prevent processing that the law permits or requires without consent.
Provide accurate, complete and current information, and promptly correct material errors or changes relevant to an application, account or clinic relationship. Do not submit fictitious applications, inflate invoices or loan amounts, impersonate another person, or misuse financing, funding or refunds. Information about another person may be supplied only with the necessary authority and permissions, and after making that person aware of the relevant purposes.
Protect passwords and verification codes, use only accounts you are authorized to access, and promptly report suspected misuse. Clinics must restrict access to authorized staff and promptly remove access when it is no longer appropriate. A clinic or representative cannot give a patient's credit, biometric or optional marketing consent merely by initiating an application or entering patient information.
When applying for financing or clinic participation, you authorize Beautifi, subject to applicable law and any separately required consent, to verify the identity and authority information you provide using relevant documents, verification providers and lawful independent sources. These checks support accurate applications and help prevent fraud, money laundering, terrorist financing and sanctions evasion. Identity methods may include government-issued identification, authorized credit-file information and other reliable sources. Credit-file use remains subject to section 3.
For clinic onboarding, verification includes clinic existence, ownership and authority, together with relevant sanctions and politically exposed person checks. At a borrower's loan-signing stage, we may request information about the transaction and, where reasonably necessary, the source of funds or wealth. You agree to cooperate with reasonably necessary verification and provide accurate supporting information. Our Privacy Policy describes the information and purposes involved.
We may decline or pause an application or withhold an advance where verification is incomplete, information is materially inaccurate, or proceeding would be unlawful, subject to any existing contractual commitment and applicable law. We may make disclosures to competent authorities, including FINTRAC, only where required or permitted by law. We may withhold investigation details or reasons only to the extent permitted by law; this does not remove legally required explanations, notices or access rights.
When you agree to sign your loan agreement, you declare that, unless you have disclosed otherwise to Beautifi before that step, you are not a politically exposed person (PEP) or head of an international organization (HIO) and, to the best of your knowledge, you are not a relevant family member or close associate of one. Any disclosure you make must be accurate and complete to the best of your knowledge. If a category applies or you are unsure, tell us through your application contact or privacy@beautifi.com before agreeing to sign. You do not need to disclose sensitive details in an ordinary email; we can arrange an appropriate method.
PEPs include people holding specified senior government, political, judicial, military or state-enterprise positions. Canadian PEP status generally covers current office and the five years after leaving it; foreign PEP status also covers former office without that time limit. HIOs include people who currently head, or within the last five years headed, qualifying international organizations or institutions, including international sports organizations. Relevant family includes a spouse or common-law partner, children, parents, parents-in-law and siblings. Close associates include certain close personal or business relationships. The categories and applicable periods are explained in FINTRAC's PEP and HIO guidance.
This declaration is an information requirement, not a statement that such status is unlawful or that it automatically disqualifies an applicant. If you discover that information provided for signing was materially incorrect, notify us promptly.
Beautifi does not provide medical advice, diagnoses or treatment. Clinics are responsible for their professional advice, treatment decisions, informed consent, services and compliance with applicable laws and professional requirements. Listings, referrals and financing approval are not guarantees of a provider's services or treatment outcome. Nothing requires a clinic to act contrary to the requirements of its professional college or another regulator, and nothing limits Beautifi's own obligations under law or its agreements.
If a clinic refunds an amount relating to treatment or procedures funded by Beautifi, the clinic must remit that financed refund amount to Beautifi for application against the borrower's outstanding loan balance. Any surplus is handled in accordance with the loan agreement and applicable law. Contact Beautifi promptly about cancellations or refunds. A clinic's promise of a refund does not by itself change your payment obligations; any adjustment is governed by your loan agreement and applicable law. This paragraph does not limit statutory cancellation, refund or other consumer rights.
Submitting a "Partner with Beautifi" or other provider enquiry requests contact about offering payment plans. It does not enrol the clinic, authorize a personal credit check on its representatives or create a fee commitment. Participation requires Beautifi's approval and acceptance by an authorized representative of the applicable clinic agreement. A profile, enquiry or portal invitation alone is not approval to offer a program.
Clinic participation, pricing and fees are governed by the applicable clinic agreement and any separately signed pricing schedule. A schedule applies only to the entities, locations and programs it identifies and may not cover all pricing or program structures offered at a clinic. Additional arrangements require separate agreement. Clinics cannot approve credit, vary a patient's loan terms or bind Beautifi without express written authority. The clinic agreement governs the commercial relationship and any negotiated exceptions.
We may use the contact details you provide to respond to enquiries and administer applications, verification, accounts and clinic relationships. Electronic documents and signatures are used subject to applicable law and the transaction's disclosures and acceptance requirements.
Optional marketing may promote Beautifi's products or other products and brands we own or are affiliated with. Beautifi may send those messages, and identified affiliates may receive relevant information and contact you directly, within the scope of your separate marketing consent. Declining marketing does not affect eligibility for financing. You may unsubscribe at any time. Accepting these Terms does not by itself give optional marketing or biometric consent.
Use the Services only for lawful personal purposes or authorized clinic business. Do not access or disclose another person's information without permission; upload malicious code; bypass security; disrupt the Services; infringe rights; or use automated collection or scraping without written permission, except where expressly permitted by law.
Beautifi and its licensors own the websites, software, trademarks and content, except material owned by others. You may view, download and print content for the permitted uses, keeping ownership notices intact. You may not otherwise reproduce, distribute, sell, adapt, create derivative works from, or use our content or marks without permission, except as permitted by law.
If you submit clinic profile material for publication, you retain ownership and confirm that you have the necessary rights and permissions. You grant Beautifi a non-exclusive, royalty-free licence to reproduce, format and display that material to operate and promote the clinic's Beautifi listing and agreed partnership activities. This licence does not authorize publication of patient information or override privacy or separate contractual restrictions.
To the extent permitted by law, websites, tools and general information are provided "as is" and "as available," without express or implied warranties, including merchantability, fitness for a particular purpose, title or non-infringement. We do not guarantee that access will be uninterrupted, secure or error-free, or that information will always be complete, accurate or current. We may correct errors, change content or discontinue website features. These exclusions do not apply to legal warranties or obligations that cannot be excluded, or to express commitments in your loan or clinic agreement.
Independent websites, sign-in providers and third-party products have their own terms and privacy practices. We do not control them or guarantee their performance. A link or referral is not an endorsement or a release of Beautifi's responsibility for its own acts or obligations. The warranty exclusions in this section do not apply to Quebec consumers to the extent they would relieve Beautifi of consequences of its own act or that of its representative.
To the fullest extent permitted by law, Beautifi, its affiliates and their respective directors, officers, employees and agents are not liable for losses or damages arising from access to, use of or inability to use the websites, tools or general information, including direct, indirect, incidental, consequential, special or punitive damages, loss of data, profits or business opportunity. This limitation does not exclude express obligations in a loan or clinic agreement or liability that cannot lawfully be excluded.
To the extent permitted by law, you agree to indemnify Beautifi and the persons identified above against third-party claims, losses and reasonable legal costs to the extent caused by your unlawful use of the Services, fraud, infringement of another person's rights or material breach of these Terms. This does not require you to indemnify anyone for their own wrongful conduct. We will give you reasonable notice of a claim and an opportunity to participate in its defence. No settlement may impose an admission or non-monetary obligation on you without your consent.
The liability limitation and indemnity above do not apply to Quebec consumers. In all cases, they do not exclude liability for fraud, intentional misconduct, gross negligence, bodily or moral injury, or any liability or consumer right that cannot lawfully be excluded or restricted.
Subject to applicable law and our existing agreements, we may suspend, restrict or terminate access to the Services at our discretion, including for misuse, breach, incomplete verification, security concerns or legal reasons. We may act without advance notice where legally permitted, including where necessary to protect people, information or the Services. We provide any notice and reasons required by law. Restricting online access does not itself cancel a loan or change payment obligations. Contact us for help administering an existing account if online access is unavailable.
We may revise these Terms and post the revised version and date. Changes apply prospectively. Material changes affecting existing users are subject to any notice and acceptance required by law; continued use is treated as acceptance only where legally permitted and after applicable notice. For Quebec consumers, changes require express agreement unless another legally permitted amendment process is followed. A website update does not itself amend a separate loan agreement, payment authorization, clinic agreement or pricing schedule, or expand a consent where new consent is required.
These Terms are governed by the laws of British Columbia and applicable federal Canadian laws, subject to mandatory laws where you reside. To the extent legally permitted, disputes under these Terms are subject to the exclusive jurisdiction of the courts of British Columbia. This does not restrict a consumer's mandatory right to another governing law or forum. For Quebec consumers, Quebec law and applicable federal law govern, and Quebec consumers retain their rights to bring proceedings before the courts available under applicable law.
If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. A failure to enforce a provision is not a waiver of the right to enforce it later. These Terms do not require arbitration or waive any non-waivable right to participate in a class proceeding.
